2. Applicability

  • These terms apply to all offers and agreements between Old Goods and customers.
  • In case of conflict, the most favorable condition for the consumer applies.

3. Products & Condition

  • Old Goods sells vintage and second-hand items.
  • Items may show signs of wear and age.
  • Not all imperfections are listed.
  • Major defects affecting use will be disclosed.
  • By purchasing, the customer accepts the condition unless additional info is requested beforehand.

⚠️ Lighting products may not meet modern safety standards — professional installation is recommended.

4. Orders & Agreement

  • An agreement is formed once the order is accepted by Old Goods.
  • Old Goods may refuse orders or set additional conditions.
  • Orders are confirmed electronically.

5. Pricing

  • Prices include VAT (margin scheme for second-hand goods).
  • Prices may change due to legal or market conditions.
  • Deposits are non-refundable.
  • Ownership remains with Old Goods until full payment is made.

6. Payment

  • Full payment is required before delivery or pickup unless agreed otherwise.
  • Late payments may result in:
    • Interest charges
    • Collection costs (legal limits apply)

7. Delivery

  • Delivery is made to the address provided by the customer.
  • If delivery is delayed beyond 30 days, the customer may cancel the order.
  • Risk transfers to the customer upon delivery.

8. Right of Withdrawal (Consumers only)

  • Consumers have a 14-day return period after receiving the item.
  • Business customers are excluded.

Conditions:

  • Product must be returned in original condition (as reasonably possible).
  • Return shipping costs are paid by the customer.
  • Customer is responsible for depreciation caused by misuse.

9. Refunds

  • Refunds are issued within 14 days after receiving the returned item.
  • Refunds use the original payment method.

10. Exclusions from Withdrawal

No right of withdrawal for:

  • Custom-made items
  • Fully performed services
  • Digital content after consent
  • Auction purchases
  • Price-dependent (market fluctuation) products

11. Rental Terms

  • Rental price: 15% of retail value per week
  • Deposit: 50% of retail value
  • Refund after return: 35% of retail value
  • Damage or loss = full retail price charged
  • Customer is responsible for transport and condition

12. Complaints & Damage

  • Complaints must be submitted promptly with clear photos.
  • Old Goods responds within 14 days.

Transport damage:

  • Item will be collected
  • Full refund after return

13. Liability & Guarantees

  • Products must meet reasonable expectations and description.
  • Additional guarantees do not limit legal rights.

14. Privacy & Data

  • Data is used for:
    • Orders
    • Shipping
    • Communication
  • Data is not sold to third parties
  • Stored up to 7 years (legal requirement)
  • Customers may request access, correction, or deletion

15. Cookies

16. Disputes

  • Dutch law applies to all agreements

17. Important Notes (High Impact)

  • All items are used/vintage → condition is never “new”
